These terms apply to your use of this website and to all purchases made from FOCI Industrial Distribution, a division of FOCI Group (Pty) Ltd (Registration No. 2020/104750/07), 152 Dallas Avenue, Waterkloof Glen, Pretoria (“we”, “us”). By using the website or placing an order you agree to these terms.
1. Products and information
We take care to describe products accurately. Images are for illustration, and specifications, packaging and appearance may change by the manufacturer without notice. Please confirm critical specifications with us before ordering. Technical guidance we give is offered in good faith; final selection and correct installation remain the buyer’s responsibility and must be done by suitably qualified persons where required by law.
2. Prices
Prices are in South African Rand and include VAT at 15% unless stated otherwise. Prices may change without notice and are confirmed when your order is accepted. If an obvious pricing error occurs we will contact you before processing and you may cancel the order. Written quotations are valid for the period stated on the quotation.
3. Orders and acceptance
An order is an offer to buy. A contract is formed when we confirm acceptance and payment has been received, or when we accept a signed purchase order from an approved account customer. We may decline an order, for example where stock is unavailable; any payment received for an unfulfilled order will be refunded in full.
4. Payment
Payment is by EFT or the other methods shown at checkout. For EFT, use your order number as the reference. Orders are processed once funds reflect in our account. Ownership of goods passes to you only once payment has been received in full.
5. Delivery and risk
Delivery times are estimates. Risk passes to you on delivery to your nominated address or when you collect. Please inspect goods on arrival and report damage or shortages within 48 hours. See our Delivery & Returns policy.
6. Returns, cancellations and warranty
Returns, cancellations and warranty claims are handled in line with our Delivery & Returns policy, the Consumer Protection Act 68 of 2008 (where applicable) and the Electronic Communications and Transactions Act 25 of 2002.
7. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, including loss of production, downtime or profit, arising from the use of or inability to use any product. Our total liability is limited to the price paid for the relevant product. Nothing in these terms limits rights you have under the Consumer Protection Act.
8. Website use
You may not misuse this website, attempt to gain unauthorised access, or copy its content for commercial use without permission. Product names and trademarks belong to their respective owners.
9. Privacy
We handle personal information as described in our Privacy Policy.
10. General
These terms are governed by the laws of the Republic of South Africa. We may update these terms from time to time; the version on the website at the time of your order applies.
